These Terms & Conditions, will apply to any contract between us for the sale of Products to you (Contract). Please read these Terms & Conditions carefully and make sure that you understand them, before ordering any Products from our site. You will be subject to the terms and conditions that are in force at the time that you order goods from us.

OUR PRODUCTS.

The images of the Products on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the Products. Your

Products may vary slightly from those images.

All Products shown on our site are subject to availability. We will inform you by e-mail as soon as possible if the Product you have ordered is not available and we will not process your order if made.

 

UK DELIVERY.

Delivery costs are additional to the displayed price and vary depending on the delivery service you select, the country of delivery and the quantity/weight of goods ordered. We do not currently deliver outside the UK.

 

If your order is particularly heavy it may be subject to extra delivery charges. If any order is subject to extra delivery charges you will be advised of the additional cost before your order is despatched. You have the option to cancel the order if you do not wish to pay any additional delivery costs.

 

UK orders for delivery to a UK address. Will be recorded delivery first class. And delivered by Royal mail.or myHemes and must be signed for on delivery.

 

davidwdesigns aims to dispatch all t-shirt orders within 3 working days of confirmation the funds for your order have been cleared.

 

UK Delivery will be made to the address specified when you complete the order. Our standard UK delivery is a 3 - 7 day service (excluding weekends and bank holidays). Deliveries to the Scottish Highlands and Islands, the Scilly Isles, the Isle of Man and Northern Ireland may take slightly longer. 

 

Any estimated delivery dates specified by davidwdesigns are approximate only and not a term of the agreement unless specific dates are quoted in writing.

Payment and acceptance. - Method of Payment - Paypal

The payment charge is due at the time of ordering. All prices are inclusive of VAT at the current rates and are correct at the time of entering the information onto the system. The total cost of the order is the price of the products ordered plus the delivery charge.

 

Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually despatch an item to you, at which point a contract will be made between us. At any point up until then we may decline to supply an item to you. If we decline to supply an item to you and you have already paid for it, we will give you a full refund of any amount already paid for that item in accordance with our Refund Policy.

 

How to order.

1 - Select the goods you require and click ‘Buy Now’

2 - Choose the quantity of goods you wish to purchase.

3 - You will then proceed to the secure payment page where you may select the payment type, Paypal and complete your order. Following submission of your order we will send you an acknowledgement to the email address provided.

 

By placing an order through our website, you warrent that you are legally capable of entering into binding contracts.

 

Please take the time to read and check your order at each page of the order process. After you place an order, you will receive an e-mail from us acknowledging that we have received your order. We will confirm our acceptance to you by sending you an e-mail that confirms that the Products have been dispatched If we are unable to supply you with a Product, for example because that Product is not in stock or no longer available or because of an error in the price on our site we will inform you of this by e-mail and we will not process your order. If you have already paid for the Products, we will refund you the full amount as soon as possible.

 

We reserve the right to refuse an order. Non-acceptance of any order may result from one of the following:-

 

The product ordered being unavailable from stock.

Our inability to obtain authorisation of payment.

The identification of an error within the production information (including price)

How the contract for the goods is formed between you and us.

If we discover an error in the price of the goods you have ordered we will inform you as soon as possible. We will give you the option of reconfirming your order at the correct price or cancelling it. We are under no obligation to sell incorrectly priced goods to you at the incorrect price if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as an error.

 

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevent information was entered on to the website.

Our Returns Policy.

You may cancel your order any time within seven (7) working days, beginning on the day after you received the goods.

 

We will refund the price of the goods in full. However you will be responsible for the cost of returning the goods to us. If a refund is payable to you we will process the refund as soon as possible, and, in any case within thirty (30) days of the day you give written notice of cancellation.

 

To cancel an order, you must inform us by - email - david@davidwdesigns.com You must also return the goods to us as soon as possible. The goods do not need to be in their original packaging however in a sellable condition, and at your own cost and risk.

 

You have a legal obligation to take reasonable care of the goods while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation. This applies to all goods that are returned. Our returns policy does not affect your statutory rights.

 

If you return goods claiming they are defective, we will examine the returned goods and will notify you of your refund via e-mail within a reasonable period of time. We will process the refund due to you as soon as possible and, in any case within thirty (30) days of the day we confirm via e-mail that you are entitled to a refund for defective goods.

 

If a refund or reimbursement is payable to you, we will transfer the money using the same method originally used by you to pay for your purchase.

We will not be liable or responsible for any failure to perform, or delay in performance of any of our obligations to you that is caused by events outside our reasonable control.

C- Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;

D - Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;

E - Impossibility of the use of public or private telecommunications networks; or

F - The acts, decrees, legislation, regulations or restrictions of any government.

 

Delivery Information.

It is the customers responsibility to ensure all contact details including the delivery address are correct and that the customer is available in person to accept and sign for the delivery at all times. davidwdesigns takes no responsibility for items that fail to be delivered or signed for due to incorrect contact information, or deliveries to addresses supplied by the customer that are third-party addresses, not the customer's actual address, or addresses that are closed or inaccessible, for whatever reason, at the time of delivery. davidwdesigns takes no responsibility in any circumstances for late, incorrect or non-delivery of any goods.

Damaged or faulty goods must be reported to us within 7 days of delivery.

Garment Care/Washing.

davidwdesigns cannot be held responsible for damage caused to Goods that have been washed contrary to the washing instructions of the garment or treated with or exposed to: bleaching agents, peroxide, chemical admixtures, optical brighteners, or chlorine, where discolouration or aging may result. It is the Customer's responsibility to read and adhere to all accompanying material giving recommended care instructions, as a general rule all printed garment should be washed inside out at 40 degrees and not tumble dried. Also iron inside out, Do not bleach, dry clean, Never iron on an exposed image. 

 

Drawings.

Some of The designs on the t-shirts are small elements from a bigger piece of Artwork that David created over 30 years ago, Some drawings have been altered for the purpose of creating a t-shirt design . And are all Copyrighted. And any copying will constitute a violation of the Copyright Act.

 

Artwork.

Drawings are a print of the original artwork.

Delivery for Artwork will be 7 to 10 days.

Artwork must be signed for on delivery.

Intellectual property rights.

Unless otherwise specified the intellectual property rights in the contents of all the pages in this website, are owned by davidwdesigns
